Claim review and advisory
Advisers and experts have different duties. As advisers we work in your interest and help you make decisions. As experts our duty is to the tribunal. We tell you at the outset which role we are in, and if we have advised you on a dispute we will not act as your testifying expert in it without telling everyone affected.
Independent claim review
A candid view of a claim before you spend on it: whether the entitlement holds, whether the records support it, and what a tribunal is likely to make of the numbers. We also give early merits and quantum notes to funders, with sensitivity ranges.
Claim preparation and defence
Extension of time, prolongation, disruption and variation claims prepared or answered from the contract and the records, including consolidated claims on major projects.
Pre-contract and contract advice
Review of contracts and professional appointments for risk allocation, notices and change and claims provisions, with practical recommendations before you sign.
Project advisory
Planning and project controls, commercial management, productivity reviews and recovery of projects in difficulty.
Support to counsel
Analysis to support pleadings and settlement strategy, as a non-testifying consultant. We do not provide this support in a matter where one of us is, or may become, the testifying expert.
A frank second opinion
An international engineering and contracting company asked us to review a claim valued by another consultancy. We found significant weaknesses in both the analysis and the valuation, and advised that only a fraction of the sum was likely to be recovered. The client decided not to pursue it, avoiding legal and expert fees and the risk of paying the other side’s costs. It cost us the work. It also told the client what our advice is worth.
