Pre-contract advice

Before a construction project starts, contractors and employers need a clear understanding of the objectives, and a contract that defines each party’s obligations and works in practice.

What we do

We review and draft construction contracts and professional services agreements, and identify contractual risk. We check that obligations and responsibilities are clearly defined and that the contract’s mechanisms and provisions are workable.

Why it matters

We highlight adverse risks and explain their consequences, so they can be removed or managed before you sign. Time spent on the contract at the start is usually far cheaper than resolving a dispute later.

Example

A UAE civil engineering contractor asked us to review the contract for a large infrastructure project. We found ambiguities and inconsistencies and a risk that could have led to a loss of around USD 1 million. Our client renegotiated and agreed revised terms.
