Quantum expert evidence

Quantum is the money in a construction dispute: what the claims and counterclaims are worth, on the contract and on the records. Our quantum experts started on site and in commercial teams, and they value claims the way the contract and the evidence require, not the way either party would like.

What we assess

  • Prolongation and time-related costs
  • Disruption and loss of productivity, including measured-mile analysis
  • Head office overheads and loss of profit or opportunity
  • Variations, measured work and re-measurement
  • Preliminaries thickening, acceleration and idle time
  • Subcontractor claims and pass-through claims
  • Liquidated damages, retention and performance bonds
  • Defects, rectification and counterclaims for work not to specification
  • Late payment, financing and interest
  • Final accounts and accounts reconstructed from first principles
  • Early merits and quantum opinions for funders, with sensitivity ranges

Where we give evidence

  • International arbitration.
  • Court proceedings, including in Scotland, and in support of matters before UAE courts.
  • Adjudication in the UK.
  • Pre-arbitral expert procedures and expert determination.

How we work

  1. We agree the questions we are asked to answer, in writing.
  2. We go to the contract and the contemporaneous records first, then the parties’ claims.
  3. We value each head of claim on a stated method and say where the records do not support a figure.
  4. We meet the other side’s expert in good faith and record agreements and disagreements in a joint statement.
  5. We give oral evidence when required and answer questions as we would for the tribunal, whoever asks them.
